Types of Motorcycle Accidents

Types of Motorcycle Accidents

Our motorcycle accident lawyers at Gruber Law Offices have seen how motor vehicle drivers’ failure to detect and recognize motorcyclists can cause accidents. Often, drivers simply refuse to respect motorcyclists’ right to share the road.

The most common types of motorcycle accidents our lawyers handle involve motor vehicle drivers who:

  • Fail to yield the right of way to motorcyclists
  • Try to share a lane with a motorcycle
  • Follow motorcycle riders too closely, or “tailgate” causing the motorcycle to be hit from behind
  • Fail to check their mirrors and blind spots for motorcycles
  • Make turns or change lanes without using signals

These are all acts of negligence. Often, drivers make careless and reckless choices that cause these crashes such as driving while drunk or while distracted by texting or talking on a cell phone. If a car driver who was engaged in any of these acts caused your motorcycle crash, you would have the right to bring a claim for compensation.

Car Accident Settlement $3.7 Million

In 2021, our Gruber Law Offices team obtained a $3.7 million settlement on behalf of a seriously injured husband and wife. Specifically, this matter involved a car crash that occurred in Waukesha County, Wisconsin. Our clients suffered serious injuries, primarily involving a traumatic brain injury. The case also involved several legal causes of action and significant motion practice, briefing, and depositions. The legal side of the case also involved contested liability, insurance limitations, insurance coverage analysis, as well as other unique and challenging issues. Our legal team pursued an innovative, unique strategy to address some of the insurance coverage issues and other legal intricacies.

Truck Accident Settlement $10.24 Million

In 2021, we resolved a crash for $10.24 million. In this case, we represented two family members and the Estate of an individual who tragically passed away. The case involved orthopedic injuries as well as a traumatic brain injury. The injuries and impact on the family were horrific. We filed a formal lawsuit in Jefferson County, Wisconsin, about halfway between Milwaukee and Madison. The case was aggressively defended based on liability and damages. The case involved a great deal of expert testimonials, depositions, and insurance coverage analysis. We filed several different causes of action including a traditional negligence claim, a negligent hiring, training, and supervision claim, along with claims against the broker. We aggressively handled the case and resolved it for $10.24 million.

Car Accident Verdict $4.8 Million

Gruber Law Offices won a $4,865,750 million jury verdict in Milwaukee County.

This verdict came after a several-day jury trial in front of Judge Mary Triggiano. The $4.86 million verdict drastically beat the defendant’s settlement offers before trial. In fact, the defendant’s insurance company made a settlement offer of approximately $150,000 at mediation. Around a week before trial, the insurance company upped their offer to $225,000 which we turned down. The jury verdict came back at $4.8 million with some negligence reductions. The case was subsequently settled. We are proud to stand up for our clients.

Motorcycle Accident Settlement $3.25 Million

In 2019, we secured a record-setting $3,250,000 settlement. Based on our research, Gruber Law Offices believes this $3.25 million settlement is the largest reported wrongful death settlement or verdict ever for a crash that occurred in Juneau County, Wisconsin. The case involved a truck vs. motorcycle crash that occurred in Juneau County, Wisconsin. A semi-truck rear-ended another truck with one of the trucks then collided with a motorcyclist. Gruber Law Offices represented the family of the deceased motorcyclist in a wrongful death case on behalf of a 60-year-old man who died due to injuries sustained in this tragic crash. The case involved a detailed analysis and presentation of Wisconsin wrongful death law and statutory caps, as well as significant involvement from expert forensic pathologists regarding potential conscious pain and suffering among other legal and medical issues. Although of course no amount of money will bring him back, we are extremely satisfied that this result represents accountability, responsibility, and justice. We were honored to have helped and represented a wonderful and loving family.

How Motorcycle Insurance Affects Your Accident Case

How Motorcycle Insurance Affects Your Accident Case

If the person who hit you is insured:

Motor vehicle drivers in Wisconsin must carry minimum amounts of liability insurance coverage under Wisconsin law. So, if you are a in crash that a car or truck driver causes, you likely should be able to file a claim with the at-fault driver’s insurance company. Our team will help you to pursue maximum compensation. Always keep in mind your underinsured coverage from your own policy as well. This can come into play if the other party does not have enough insurance.

If they are not insured or do not have enough insurance:

If the at-fault driver has no insurance or has insurance that fails to cover all of your medical bills and other losses? Our motorcycle accident law firm can explore all of your options, which often from a practical standpoint includes filing a claim with your own insurer for one of the coverages that you pay premiums for, called uninsured motorist coverage or underinsured motorist coverage. It is important to speak with an experienced and proven personal injury law firm in this situation. You should also consider several different insurance options such as medical payments coverage and/or uninsured motorist / underinsured motorist (UM/UIM) coverage that may be available to you from other sources.

These are very important to consider in a motorcycle crash. Whether you are dealing with the other driver’s insurance company or your own insurer, Gruber Law Offices will make sure to protect your rights. You need a powerful team with resources to fight and win for you and your family. Representation will also be especially important if the insurer tries to argue that you were negligent or responsible.

Wisconsin’s Comparative Negligence Law:

Under Wisconsin’s comparative negligence law, if you are found to be 51 percent or more at fault for an accident, you can be barred from recovering anything regardless of how severe your injuries are. If you are less than 51 percent at fault, you can still recover damages, but your damages will generally be reduced according to the degree or percentage of fault assigned to you. We know how insurance companies try to use this law against motorcycle riders…we see it frequently. We will fight hard to get you what you deserve.

Common Motorcycle Accident Injuries

Common Motorcycle Accident Injuries

Our lawyers realize the severity of the injuries that motorcycle riders – and their families – must cope with after an accident. Gruber Law Offices helps motorcyclists who suffer from:

  • Head and brain injuries
  • Back and spine injuries
  • Multiple broken bones
  • Loss of limbs
  • Chest and shoulder injuries
  • Eye injuries
  • Burns, including friction burns or “road rash”
  • Scarring and disfigurement.

If you wear a helmet, you greatly reduce your risk of a concussion or more serious form of traumatic brain injury. That is why we encourage motorcycle riders to always wear helmets. However, at Gruber Law Offices, we respect motorcyclists’ right to ride without a helmet (unless you are under age 18 or carrying an instructional permit). We will stick up for you and fight an insurance company’s attempt to use your lack of a helmet against you.

gruber motorcycle-07Order a copy of your crash report. You should be able to get a copy from the law enforcement agency that responded to your motorcycle crash. You can also buy accident reports online at the Wisconsin Department of Transportation website.[/su_column]

Wisconsin generally requires you to file a personal injury claim within three years after the date of an accident. If you lose a loved one in a crash, you have three years from the date of death to file a wrongful death lawsuit. Your lawyer will need time to properly prepare a claim for filing. So, do not delay getting help after a motorcycle crash. Connect with Gruber Law Offices today.
