The injury required multiple lumbar injections and ongoing care. Her treating physician testified she will need additional injections in the future. The The defense disputed permanence and attempted to minimize both the injury and its impact on her life, but the jury found the loss to be life-changing and returned a significant verdict in her favor.
Crash Details
The collision occurred on a rural road in Dane County, Wisconsin, just outside Madison, when the other driver crossed the center line and struck the client nearly head-on. The defendants stipulated that the other driver was 100% at fault for the accident but aggressively disputed the real impact in her life.
Injuries and Treatment
The client’s primary diagnosis was a facet joint injury. Facet joints connect the vertebrae and permit the spine to bend and twist; nerve roots pass nearby and can be a source of chronic pain when those joints are damaged. After attempting conservative care, she underwent multiple procedures, including radiofrequency ablations. Radiofrequency ablation is a pain-management procedure that uses heat to disrupt affected nerves. Commonly called an RFA, it can reduce pain but does not permanently fix the underlying problem. The client experienced meaningful relief from these procedures but will likely need additional ablations in the future to manage chronic pain. Over several years she also pursued physical therapy, chiropractic care, SI joint injections, and medical branch blocks.
